Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the https://www.thebiotagroup.com/ and https://shop.thebiotagroup.com/ websites (the "Service") operated by The Biota Group ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Purchases
When you finalize an order with The Biota Group, you are agreeing to our our Livestock Guarantee Policy, all the policies listed on our FAQ Page, and our Acclimation procedure.
When you place an order with The Biota Group, you consent to our Shipment Contract. With this shipment contract, the buyer bears the risk of loss for the goods prior to actually receiving them. The Biota Group's duty is to get the goods to the carrier and make proper delivery arrangements. After this, if any loss occurs the buyer bears the risk of loss and is responsible for the costs. Shipping service costs are non-refundable.
If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your name, address, phone number, and email address.
We reserve the right to cancel an order at any time for any reason. A10% cancellation fee will apply to all canceled orders. By completing and submitting the electronic order form (or proceeding through the 'checkout process') you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. Neither submitting an electronic order form or completing the checkout process constitutes our acceptance of your order.
The materials appearing on The Biota Group’s web site could include technical, typographical, or photographic errors. The Biota Group does not warrant that any of the materials on its web site are accurate, complete, or current. The Biota Group may make changes to the materials contained on its web site at any time without notice. The Biota Group does not, however, make any commitment to update the materials.
You further acknowledge and agree that The Biota Group shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through our web sites or services.
Livestock Size and Coloration
Please allow for variations in the size of fish which may deviate from the listed size. Captive bred fish often tend to be smaller, but this does not affect their survival in proper conditions.
We do our best to accurately represent the coloration of our animals. Each animal is unique and may exhibit color variation. Many animals change color naturally over time and in varying conditions. Please note, coloration in our photographs is affected by many factors including your computer's monitor, where the animal is in relation to the lighting, the color spectrum of the lighting, and variations in white balancing. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
